Terms and conditions
§ 1 Scope, obligations and costs
These terms and conditions apply when people take part in competitions and tenders organized by San Hejmo GmbH (Katharinenquartier 4-6, 47652 Weeze).
Participation is free of charge and without obligation for the participants. Likewise, the chances of winning are not influenced by any services provided by the participants.
In the event of winning festival tickets for the San Hejmo Festival, the General Terms and Conditions of San Hejmo GmbH (https://www.sanhejmo.com/en/gtc) and its data protection conditions (https://www.sanhejmo.com/en/data-privacy) apply.
In the event of winning festival tickets for the Parookaville Festival, the General Terms and Conditions of Parookaville GmbH (https://www.parookaville.com/en/gtc) and its data protection conditions (https://www.parookaville.com/en/data-privacy) apply.
By participating in the competition, you agree to these conditions of participation.
§ 2 Eligibility
Individual natural persons aged 18 and over who are resident in Germany are eligible to participate. Representation is not permitted. Employees of San Hejmo GmbH and employees of cooperation partners who are or were involved in the creation or processing of the competition are excluded from participation in the competition. Otherwise, San Hejmo GmbH is entitled to exclude this person from the competition. Only one entry per person is permitted.
§ 3 Settlement
Participation takes place in the manner described in the prize text (e.g. by leaving a comment under the corresponding official post authorized by San Hejmo GmbH on the respective social medium, by participating in a survey conducted by San Hejmo GmbH, by participating in a lottery conducted on site as part of the San Hejmo Festival or by simply purchasing festival tickets from San Hejmo).
The winners will be drawn at random. Winners will be selected from all participants who have correctly registered in accordance with the mechanics of the prize draw. There is no legal recourse with regard to the drawing of the winners.
The prize corresponds to the wording on the published prize text. The winners will be contacted as described in the published prize text (e.g. via the e-mail address provided, via PN via the corresponding social medium). Three attempts will be made to contact the winners.
The winners must always contact San Hejmo GmbH after the deadline specified in the competition. If no such deadline is specified in the competition, they must contact San Hejmo Ltd. within 24 hours of the announcement of the winners. The organizer accepts no responsibility for entries that are lost or delayed for any reason.
The winner will be informed via email to the address provided in the competition form or via PN on Facebook/Instagram or other social media.
After expiry of this period, San Hejmo GmbH reserves the right to determine and announce new winners at random.
All other costs incurred in connection with the prize (e.g. shuttle, meals) are to be borne by the winners themselves and will not be covered unless expressly stated otherwise in the competition.
Payment of the prize in cash, its exchange or transfer to other persons is not possible. A winner may waive their prize. In this case, the prize will be forfeited. Payment to a third party selected by the winner is not possible.
The participant confirms that his/her data may be used to notify the winner and to send the prize to the respective address in the event of a win. Festival tickets will be sent by e-mail. The participant's data will not be passed on to third parties under any circumstances; the ticket service provider Ticketpay is not considered a third party within the meaning of these conditions.
§ 4 Data protection information on the competition
Data will be protected in accordance with legal regulations. They will only be processed in the context of the implementation of the competition and, in the event of a win, for its processing and will be deleted once the purpose of their processing has been achieved.
§ 5 Liability
San Hejmo GmbH is only liable - regardless of the legal basis - if damage is caused by culpable breach of a material contractual obligation (cardinal obligation) in a manner that jeopardizes the achievement of the purpose of the contract or is due to intent or gross negligence. If San Hejmo GmbH is liable in accordance with the above paragraph for the breach of an essential contractual obligation without intent or gross negligence, liability is limited to the extent that San Hejmo GmbH could typically expect at the time of conclusion of the contract on the basis of the facts known to them at that time.
The above limitations or exclusions of liability do not apply in the event of culpable injury to life, limb or health, for liability claims under the Product Liability Act and in the event of a contractually agreed no-fault obligation to assume liability or if the relevant circumstance giving rise to liability has been fraudulently concealed.
Insofar as the liability of San Hejmo GmbH is excluded or limited in accordance with the provisions of this exclusion of liability, this also applies to the personal liability of executive bodies, employees, representatives and vicarious agents.
§ 6 Changes to the rules of participation and termination of the competition
San Hejmo GmbH reserves the right to change the conditions of participation at any time.
Furthermore, San Hejmo GmbH reserves the right to terminate or interrupt the competition or prize draw at any time for good cause without prior notice. This applies in particular to reasons that would disrupt or prevent the competition or prize draw from proceeding as planned. If such a termination is caused by the behavior of a participant, San Hejmo GmbH is entitled to demand compensation from this person for the damages incurred.
In exceptional cases, special conditions of participation apply, which are clearly indicated for the competition in question. In the event of a conflict, these take precedence over these general terms and conditions.
In addition, the organizer reserves the right to exclude persons from participation at its own discretion if there are justified reasons, for example
in the event of manipulation in connection with access to or execution of the competition
in the event of breaches of these conditions of participation
in the event of unfair trading or
in the event of false or misleading information in connection with participation in the competition. The Promoter's decision on all aspects of the Promotion is final and binding and no correspondence will be entered into.
§ 7 Social media
If competitions are held via social media, they are in no way connected to the respective social medium and are in no way sponsored, supported or organized by it. The recipient of the information provided by the participants and the winners is not a social medium, but San Hejmo GmbH. Participants indemnify the platforms against all third-party claims (including reasonable legal fees) insofar as they are caused by unlawful conduct on the part of the participant.
Questions, comments or complaints about this competition should not be addressed to the respective social medium, but to San Hejmo at the e-mail address gewinnspiel@sanhejmo.com.
§ 8 Additional conditions
Further conditions of participation (e.g. duration of the competition, type and scope of the prize) are specified in the respective competition.
Should individual provisions of the conditions of participation be or become invalid, the validity of the remaining conditions of participation shall remain unaffected. They shall be replaced by an appropriate provision that comes closest to the purpose of the invalid provision.
Errors in the presentation of the prize are reserved. Cash payment of the prize is not possible. The rights arising from the privacy policy remain unaffected.
